摘要
相关市场是经营者在一定时期内就相关商品(服务)进行竞争的商品范围和地域区域。对相关市场的界定是认定市场支配地位的前提条件。虽然知识产权不等于市场力量,但具有市场力量的知识产权权利人为维持现状或实现垄断目的,单方从事的排除、限制竞争的行为,如同滥用市场支配地位一样种类繁多。反竞争意图是认定垄断与试图垄断行为非法的关键因素。从提起垄断诉讼的身份要求看,有着惰性的政府和难以组织起来的集团诉讼往往可能成为一个次优的选择。
Relevant market is the commodity range and the geographical area in which practitioners compete over certain com- modities (services) in a certain period of time. The definition of relevant market is the precondition to clarify market dominance position. Although intellectual property itself does not constitute market power, its right owner, if armed with market power, may try various ways to eliminate or restrict competition, such as abuse of dominant market position. The intent of anti - competition is to define and clarify key factors involved in monopoly and atterrlpts of monopoly. Judged from identity requirements in monopoly suits, the inert government and group actions that difficult to organize are often a second -best alternative.
