摘要
对支持或反对商业方法专利学者们争论的主要问题进行了归纳总结,简介了Bilski案及美国商业方法专利的最新政策。在此基础上,提出赋予商业方法专利权可以促进相关部门的技术创新,解决美国商业方法专利问题应当是积极寻求改进专利审查的方案,同时中国应主动借鉴国外的立法与实践,建立起商业方法专利保护制度。
As far as the protection for business method patent are concerned,there is much divergence in the research of international legislation and judicature.The field of theory has probed this issue for many years.This paper summarizes key controversy to for or against the protection for business method patent and introduces briefly Bilski case for understanding the latest development of this policy.Based on this,this paper puts forward the protection for business method can accelerate technical innovation of related industries.Also,USPTO should seek the scheme improving patent examination positively.Furthermore,it is essential to establish the system of protection for business method patent in China.
