摘要
契约内含着自由的成分,契约自由是契约的逻辑延伸,也是契约伦理的核心和灵魂。契约自由是契约得以订立的根本前提,订立契约的双方必须是平等的、自由的,契约活动是一种自主自愿的活动;同时,自由意味着责任,总是会受到一定的限制和约束。契约自由原则的伦理内涵包括:自愿合意原则、自由与道德责任相结合原则、契约自由的有限性原则。
The contract contains composition of freedom.The freedom of contract is a logical extension of contract,the core and the soul of contract ethics as well.The freedom of contract is the fundamental premise to conclude contracts,The contract between both sides must be equal and free.Meanwhile liberty means responsibility,limited and constrained somehow.
