摘要
近现代法律上的人格深深植根于人格的伦理性之中。人格的伦理性内涵表现为法律对人的一般法律地位的确认、人格权对人本体的保护以及作为技术人格的权利能力。近现代法律的人格经由形式平等发展至实质平等,仍然是基于对人格的伦理性的保障。
In modern times,personality in law is deeply rooted in ethical characters which involve the general status of person in law,the regulations of personality rights and the technical personality in civil law.The equality of personality in form and essence are both based on ethical personality.
