摘要
运用宪法政策保障民生是越来越多国家的普遍做法。宪法政策的适用具有鲜明的特点,如与基本权利条文、平等原则、比例原则、自由权等结合起来予以适用。宪法政策能够被适用来保障民生的深刻的法理基础源于为了更好地保障人权的实现、为了充分展示正义。宪法政策是人类自身治理社会信心的体现。在这方面,国外的做法可以为我国提供相应的启发。
It is a general practice of more and more countries to protect citizens＇ life with the policies in the Constitution.This practice has unique characteristics such as the combination with basic laws of right,equality principle,proportional principle and right of freedom.The basis of this practice lies in a better protection of the realization of human right and justice.It is a manifestation of the confidence of man to rule the society.Practice of some foreign countries can inspire us in this respect.
