摘要
我国行政立法管制领域存在着一些因过高交易成本导致的规制失灵。成本收益分析是法经济学研究范式的基本方法。降低交易成本的关键在于法制均衡,而均衡的行政立法能够最优地节减交易成本并提高其法律效益。放松管制,降低交易成本,以趋近行政立法的管制均衡,构建"善治"为基础的和谐社会。
Due to too much transaction cost,there are some malfunctions in China＇s regulation of administrative legislation.Cost-benefit analysis is the inherent demand of Lexeconics research and the equilibrium of legal system is the key to reducing transaction cost.Equilibrium administrative legislation can optimize the reduction of transaction cost and improve its legal benefit.Deregulation and less transaction cost will ensure the equilibrium of administrative legislation as well as the building of a harmonious society on the basis of ＂good governance＂.
