摘要
中国法律文化的模式特征迄今尚无研究。运用文化模式论中的构型理论剖析中国法律文化,可一言蔽之曰:官法。该官法的主要特征是,法律的合法性依赖政治权威的合法性,法律作为治之具,其功能是为配属职官实现职守。这一模式的生成原因是存在着一个强大的伦理解释话语系统,而系统话语的权力归属于官僚。
There isn＇t any research about the pattern of Chinese law culture. Official law can be used to summarize the analysis of Chinese law culture by means of structural theory in the cultural pattern. The official law is mainly featured by the fact that legitimacy of law depends on the legitimacy of political authority and law, as the tool, aims to help officials im- plement their duties. The reason lies in a powerful discourse system of ethical interpretation while the right of systematic discourse belongs to bureaucracy.
