论述了被害人在废止死刑过程中的地位及被害人因素在死刑废止进程中的重要作用。从刑罚理论角度论证了被害人在刑罚理论中的缺失,提倡建构被害人补偿制度为废止死刑的进程奠定民意基础,探讨了被害人保护措施以推动死刑废止进程。
