摘要
目前,由于我国农村土地立法不健全、集体建设用地产权不清晰,滋生了大量自发无序的集体建设用地使用权流转隐形市场。对此,提供切实可行的法律保障是集体建设用地使用权流转的基础;明晰土地产权关系是集体建设用地使用权有序流转的基本前提;作为土地市场的公共管理者和社会服务者,政府应当在避免对集体建设用地流转市场直接干预的前提下,注重运用宏观调控手段,为土地流转市场的良性发展营建公平的竞争环境。
Many disordered and invisible land markets generate owing to the distemperedness of rural land legislation and the vagueness of the property right of collective construction land.This paper suggests that providing a substantial legal protection is the foundation of transferring rural land use right and clarifying the land property right is the basic premise.As a public manager and a social server in the land market,government should pay attention to use macroeconomic control measure on the premise of avoiding direct intervention in order to create a fair competitive environment for the better development of the land transfer market.
