摘要
尽管《道路交通安全法》的一些规定尚不尽人意,但其第76条是应该肯定的。《道路交通安全法》第76条的成功之处或者贡献所在,至少体现在如下几个方面:它构建了我国机动车强制险制度的基本框架;它细化了机动车之间、机动车与行人之间发生交通事故时的责任认定;它把特殊的侵权民事责任与强制责任保险很好地结合起来。
Some regulations in Road Safety Act areless than satisfactory,but article 76 deserves affirmation.Its dedication lies in at least the following aspects.Firstly,it frames the compulsive liability insurance of the motor vehicles.Secondly,it clarifies the determination of legal liability in traffic accidents between the motor vehicles,the motor vehicles and pedestrians.At last,it combines civil tort liability with the compulsive liability insurance.
