摘要
检察长公共责任是指即使检察长未违反法律、检察官纪律,仍然可能因为不符合选民或其它主体的政治期许而受到不利后果,甚至被免去检察长职务。我国检察长采取以政治官模式为主的职业定位模式。检察长的公共责任能强化对检察权的外部制约,体现民主可问责性,实现回应型司法。但是,如果检察长的公共责任过强会招致对司法的政治干预。我国应当以检察官的司法官角色融合检察长的政治角色,将检察长的公共责任限于裁量范围,改革选举制度来消解检察长过强公共责任的弊端。
Political accountability is disadvantages or deposal faced by chief prosecutor even when no law or discipline violated.Political bureaucracy is the main form of our chief prosecutor professional identification.Political accountability may strengthen the outer supervision to the prosecutorial power with democracy and responsive justice being achieved.However,too much Political accountability may induce political interference.In china,judicial role shall syncretize the political one,political accountability shall be limited to discretion and selection process shall be reformed to reduce the excessive political accountability.
