摘要
近代以来,列强对中国的侵略给中国人民带来了深重的苦难,但客观上也传播了先进的文化和制度。列强侵华中所攫取的领事裁判权就是很好的例证。在领事裁判制度之下,列强加紧了对中国的侵略,另一方面,该制度也冲击了中国原有的法律运行模式。在这种背景之下,近代的开明之士纷纷开始了对新的法律运行模式的探索。
The aggression of western powers brought miseries and tremendous suffering to the Chinese people in modern times,but on the other hand,it objectively spread advanced culture and the system.The consular jurisdiction taken by the western powers in aggression was a good example.Under the consular jurisdiction system,western powers quickened their aggression against China,on the other hand it also shocked China＇s existing legal operation mode.Against this background,liberal-minded people started exploration of a new legal operating mode.
