摘要
适当加强法律理论修养有助于根除"人治"思想,建立现代法治观念,有助于全面提高公务员的法律素质和依法办事能力,这是增强党的依法执政能力的需要,也是加快推进法治进程的需要。当前公务员应当重点把握三个方面的理论问题:一是正确认识当代中国法的本质和功能;二是在法的价值问题上正确认识自由与秩序、公平与效率的辩证统一关系;三是正确认识和把握法治的实质。
Working hard at the theory of law reasonably will help eliminate the ideas of ＂rule of man＂,contribute to the establishment of the modern ideas of ＂rule of law＂ and improve civil servants＇ quality of law and ability to perform their official duties according to law.It is needed not only for the Party to enhance governance capability but also for China to speed up the advancement of government by law.Currently,civil servants should focus on understanding the three parts of theory of law as follows.First,the nature and the function of contemporary Chinese law should be comprehended.Second,dialectical relationships between freedom and order,fairness and efficiency which are major components of theory of law value should be comprehended correctly.Third,it is necessary for civil servants to understand and grasp the essence of the rule of law correctly.
