摘要
信访制度的救济职能与法治进程所要求的司法存在着相互冲突抵消。从两者存在所依附的经济基础及其成长所需要的政治思想的土壤方面考虑,构建的和谐社会是发达的社会主义市场经济社会,是以民主法治为首要内涵的社会,在这样的土壤上就不能移植萌芽于自然经济成型发展于计划经济以专制集权的人治为基础的信访制度。和谐社会是法治社会,是司法优先的社会,信访救济与法治及司法的先天性冲突,在和谐社会视野下,信访救济职能应予消解。
There are conflicts between remedy function of inquiry system and justice required in the process governed by law.Considering the economic basis that the two sides depend on for existence and the political thought that they need for development,the harmonious society built is the developed socialist market economy society with democracy and rule by law as its first principle and in such a society,inquiry system can not be introduced that originates from natural economy,develops in planned economy and is based on rule by man of autocratic concentration.The harmonious society is characterized by rule by law and judicial priority.The intrinsic conflicts between remedy for inquiry and justice can be solved by remedy function of inquiry in the harmonious society.The author demonstrates in detail the establishing ways of judicial authority in the harmonious society from the perspective of authoritative system,subject,course and result.
