摘要
我国房地产热背后的环境问题长期以来未受关注,片面追求经济利益的短期行为,已对环境产生了明显的负面影响。虽然我国已确立了一系列的环境法律制度,如土地利用规划制度、环境影响评价制度、三同时制度、环境标准制度、排污收费制度和环境法律责任制度等,但其实施效果却不尽人意,需要从源头真正地予以贯彻落实。其中,科学合理的城市规划、强制性的环境利益考量及公众参与制度的保障是重点。
The environmental problems brought by China’s "real estate fever" have never been realized.The short-term behavior in one-sided pursuit of economic interests has produced a significant negative influence to social environment.China has already established a train of environment legal systems,for example,Land Utilization Plan System,Environmental Impact Assessment System,Environmental Standard System,Rating System for Pollutant Discharge and Environment Legal Liability System etc.These systems should be the fundamental guarantee of environmental protection in real estate development,but the implementation is unsatisfactory in the practice.This article argues that these systems should be put into practice at root,and the scientific and rational urban planning,mandatory considerations of the environmental benefits and the system of security of public participation are the key points.
