摘要
我国村民自治的立法经历了从无到有,从不完善到逐渐完善的过程。但随着实践的推进,村民自治的法律法规建设跟不上形势发展的需要已日益显现,甚至在某种程度上影响了村民自治实践的发展。针对目前我国村民自治立法中存在的主要问题,需要从理顺法律渊源、完善法律体系、提高立法技术、吸收创新成果等方面逐步健全,以完善我国独具特色的村民自治法律法规和制度体系,推动村民自治进一步发展。
The Village legislation in china has experienced a process from scratch, from the imperfection to the gradual improvement. But with the advancement of practice, the laws and regulations of villagers self - government fail to keep up with the development of the situation. This even to some extent affects the practice of villager selfgovernment. In view of the main problems in legislation, the artide points out the need to straighten out the sources of law, improve legal system and technolegy, and assimilate original ideas, in order to improve the unique villager self - government legal system in China, and promote the further development of villager self - government.
