摘要
2009年厦门对市属国有企业进行行政划拨用地转完全出让用地的政策试验。政策设计的思路为企业的自愿原则,凡是土地企业法人为市属国有全资企业的,原为行政划拨或限制性出让用地的可通过规划咨询论证,在满足规划的前提下,本着市场价值最大化的原则,重新确定土地性质和开发强度(容积率),将这些土地通过招拍挂途径转化为完全出让用地。重新规划后的土地由国企自己摘牌,地块挂牌的土地收入,以资本金注入的方式返还企业。实施该政策就是将非正规产权转化为正式产权,在现有的利益格局下,政策设计必须同时兼顾各方利益的平衡。
In 2009, Xiamen has taken a policy experiment that transferred the assigned land into commercial land on municipal state-owned enterprises. With the principle of respecting enterprises' own accord, the assigned land or conditional assigned land which belonged to any municipal stateowned enterprises could be transferred into commercial land through the process of land bidding, auctioning and nominal quotation under the premise of meeting planning demand. Through planning consultation first, the land status and plot ratio are reconfirmed based on the principle of maximizing the market value in the process mentioned before. The lands that re-planed are bought by the state-owned enterprises themselves and the land revenue would be returned to them as the capital fund. The implementation of the policy will turn informal property rights into formal property rights, which has significant meaning for improving social welfare and promoting urban spatial structure. It is pointed out that the policy design needs to take consideration to all parties' interest for balance under current interest configuration.
