摘要
法院判决房地产买卖合同无效或者撤销后,已办理的房地产登记并非当然无效。本文通过相关之登记实务问题的研究,提出汲取历史经验、借鉴国外制度、通过法院和登记机关的互动、破解实践中的登记困境等,以利于房地产登记法律制度的完善。
By analyzing some practical questions and difficulties of invalidation or withdrawal of contract, this article intends to table a proposal for solving the puzzle of the registration of real estate, by deriving from historical experience and by learning the system and the procedure from the western when we construct our modern registration of real estate. For instance, we can write off like Taiwan, Japan and Germany when we will cancel the registration of real estate. It will be beneficial to normative operation of the registration of real estate.
