摘要
本文通过十个标准制定组织必要专利披露政策的实证分析,指出专利联盟必要专利评估的必要性,同时研究现行的专利联盟必要专利评估机制,并结合美国司法部对MPEG-2、DVD 3C以及DVD6C专利联盟必要专利评估机制的审查和实际案例研究,指出必要专利评估机制潜在的一些缺陷以及中国企业构建专利联盟,维持专利评估机制独立性的相关对策。
In this paper, we first empirically analyze essential patent disclosure policies of ten standard-setting organizations and point out it is necessary for patent pools to assess the essentiality of patents. And then we study the existing essential patents assessment mechanism of patent pools, combining with the study on the U.S. Department of Justice＇s review on the MPEG-2, DVD 3C as well as DVD 6C patent pools and practical cases, and find out some potential defects in them. Finally we propose several improvements that should be useful for building the essential patents assessment mechanism based on China＇s technical standards.
