摘要
新刑法新增了强制猥亵、侮辱妇女罪,相对旧刑法对该罪的规定(包含在流氓罪中),现行刑法在保护妇女和儿童等弱势群体的合法权益方面提供了更有力的法律保障。然而,虽然新刑法对猥亵罪进行了诸多完善,但在强制猥亵和侮辱行为不合理的并存下导致理论和司法实践诸多争议,犯罪对象的范围过窄以及猥亵犯罪中结果加重犯的处罚方面仍有许多值得商榷的地方。
The newly-enacted Criminal Act regulates a new crime named Crime of Coercive Indecent Act towards Women.Compared with the former Criminal Act,the new Act provides better protection for such weaker parties as women and children.However,although the new Act has provided better regulation of the crime of indecent act,many respects are worth reconsideration,such as the controversies resulting from the unreasonable co-existence of the coercive indecent act and the insulting act,the narrow scope of the object and the punishment of the criminal who commits a heavier crime.Therefore,some suggestions are put forward for the modification of the law.
