摘要
市场经济组织法律应当是维权型、护权型的法律。我国农民专业合作社法不仅应当科学地、明确地赋予农民专业合作社成员的权利,而且还应当建立成员权利救济制度,将成员权利的保护贯穿于整部法律。但是,农民专业合作社法应当怎样赋予成员权利,特别是在建立成员权利救济制度方面不具体、不明晰、缺乏可操作性和可诉性,这将会导致本已十分脆弱的成员权利在受到侵害时,难以得到有效维护和获得法律救济。
The market economy organization law must be the law which focuses on maintaining legal rights.Farmer specialized cooperatives should entrust the members with the rights scientifically and explicitly.Moreover right relief system must be established.But some rules on the relief system are not concrete and undefined,to the disadvantage of operation and lawsuit,result in hard to maintain legal rights and obtain law relief.
