摘要
面对当下愈演愈烈的腐败行为,我们应当抛弃原有的以教育感化为主的反腐模式,更加注重从制度上了解反腐败所具有的重要意义和深刻内涵。然而,作为当下最为重要的反腐机构之一的人民检察院,却因为领导体制存在着严重的缺陷使得其应有的反腐功能无法得到充分有效地发挥。从党的十七大报告对于司法体制改革的论述出发,探讨中国检察领导体制重构的可能性,及其对于我国反腐工作的重要意义,并对建国以来检察体制历史维度的考察将有助于我们进一步明确改革的方向。
We should give up the former model of anti-corruption which takes doctrine of education and reformation as the main stream, and it is necessary to lay more stress on the profound connotation and important meanings viewing from the system as we face with increasing corruption action. But, as the most important organ which is responsible for anti-corruption, it can not efficiently play its role because of its serious deficiency on leading system. We start from the discussion in the report of the 17th Session of CCPC on legal reformation,probe the possibility of reconstructing Chinese procurator leading system, as well as its＇ important meanings to our country＇ s anti-corrup- tion work, at the same time, have a review on the history of procurator system from the foundation of new China.
