摘要
基于文化多元的理念,认为少数民族习惯法应当享有自主发展的权利和空间,同时提出要避免文化相对论的一些极端主张所带来的误区,要把最低限度人权的保障作为民族习惯法自主发展的前提。
Based on the concept of cultural diversification, this paper argues that the customary laws of ethnic minorities should be given rights to and rooms for their autonomous development. Meanwhile, it holds that to prevent mistakes arising from the extreme claims of cultural relativism, the assurance of human rights should be taken as the premise for the autonomous development of these customary laws.
