摘要
法治是制约公共权力最有效的手段,这是具有自我纠错能力的执政党对"文化大革命"所造成灾难的原因进行反思后得出的结论。公共权力法治化的动因包括历史发展的潮流、执政党的倡导和政府的推进以及市场经济条件下社会观念的变迁,但主要动力是党和政府的推动。单一的政府推进型法治带有天然的局限性,但政府推进型法治是改革开放初期中国历史的必然选择。
