摘要
亲权是基于基本的身份关系而产生的一种专属于父母的权利和义务。随着民工潮此起彼伏的涌动,未成年子女的教育、监护、经济扶助等关涉亲权的问题愈益突出。由于学界亲权研究上的不足、国家亲权立法和保障体系上的缺陷,进一步加剧了亲权履行的缺失。鉴于现实社会中愈益严重的亲权履行缺失,以历史和国外实践为借鉴,明确亲权立法,完善亲权制度,切实保护未成年人的合法权益,保证国家人力资源的可持续性发展势在必行。
Parental right system is parents＇ rights and duties according to basic identity relation. With the increasing of farmer workers, the questions of underage＇s education, guardianship, economy help are more serious. The shortage of research and the defects of legal and social security system on parental right aggravate the question of imperfection parental right. By drawing lessons from ancient China and foreign countries, this pape expects to perfect Chinese parental right system and protect underage＇s legal fight in order to achieve sustainable development of national human resources.
