观念滞后,制度上先天不足,以及立法中的不完善,构成了中国住宅小区业主委员会目前在中国物业管理中面临困惑的几大成因,由此造成了业主、物管公司、业主委员会之间争议纠纷的频繁发生。明确中国住宅小区业主委员会的性质,并确立其法律地位,是寻求解决纠纷的司法途径基础。
