摘要
有组织犯罪有广义、狭义之分,狭义的有组织犯罪,仅指黑社会(性质)组织犯罪,其具有组织性、经济性、犯罪手段和活动领域多样化、政治腐蚀性等基本特征。加强有组织犯罪的刑事司法控制,一方面要树立常态执法理念,加大对有组织犯罪的打击力度,同时要注重惩罚犯罪与保障人权的平衡以及宽严相济刑事政策的运用。要完善具体的刑事司法制度设计,包括成立专门的防控机构、赋予特殊侦查手段、完善证人保护及污点证人制度、加强国际合作等。
The organized Crime has two kinds of defihitions： general and Special. The special definition means mafia-style ,u＇ganized crime; which has the following characteristics： organization, economy, varieties of criminal ways and activity field, corrtxting politics, To strengthen the criminal judiciary control of organized crime, we should establish nounal law-executing idea and increase strike against organized crime and at the same time pay more attention to the balance of punishing crime aed protect ng buman rights and the application of criminal policy with mercy and severity. To perfect specific criminal judiciary system design, we should set up special prevention and control institution, use special investigation ways, perfect witness protection and state witness System. strengthen international cooperation, and etc.
