摘要
专利性检索工作,要求查全和查准,最后要对相关文献进行对比分析,由于检索人员对发明点的认识发生错误以及对相关文献的对比分析不细致,造成查准率不高,严重影响专利申请人或者利害关系人的利益。文章结合自己实践专利检索工作的经验,阐述了影响专利性检索的因素,以一件具体的发明专利申请为例,运用三段论,介绍专利性分析的技巧以及应注意的问题。
Integrity and precision are needed when one is searching those materials and finally the work of comparative analysis has to be carried out in performing the task of patent retrieval. The low precision rate, which is caused by the searchers＇ understanding errors of the invention-point and careless comparative analysis of the related records, seriously affect the interests of the patent applicant or interested party. Based on his many years ＇ work experience in patent searches, taking a specific patent applications as an example, the author sets out the factors that affect the patent retrieval, and introduces patent analysis techniques and some notetaking issues in the form of syllogism.
