摘要
目的探讨换证导致的新旧GSP证书有效期间隙问题及解决办法。方法联系GSP实施及监督管理实际进行法条分析。结果与结论《药品管理法》第七十九条和《国务院关于加强食品等产品安全监督管理的特别规定》第三条,均不能作为处理换证导致的新旧GSP证书有效期间隙问题的法律依据,需要通过《药品管理法》的修订或者法律解释,对换证导致的新旧GSP证书有效期间隙问题专门作出明确规定。
Objective Discuss the issue of interval between durations of validity of GSP certificates and find a solution to that issue. Methods Article analysis of laws and regulations on the bases of actuality of surveillance and management was carried out. Results and Conclusion The issue of interval between durations of validity of GSP certificates can not be judged by Article 79 of Drug Administration Law of the People＇s Republic of China and Article 3 of Special Rules of the State Council on Strengthening the Supervision and Management of the Safety of Food and Other Products. In order to solve this issue either we get the Drug Administration Law amended or make new interpretation to present laws and regulations to make this issue clear.
