摘要
农村宅基地属于农村建设用地的一部分。目前,我国农村存在相当一部分空置宅基地,这些宅基地的合理规划、利用关系到国家节约用地目标的实现和农村治安状况的改善。文章在分析现有农村空置宅基地实况及引发的社会问题的基础上,对农村空置宅基地管理法律制度提出了几点建议:一是对农村"空置宅基地"做出明确的司法解释,确立空置权;二是完善农村空置宅基地国家法律制度;三是制订合理的农村空置宅基地配套法律制度措施;四是完善农村空置宅基地的收回的执法与监督制度。
The house sites in the country are parts of construction lands. At present, quite a few house sites are not in use in Chinese country. Making good use of the lands is important for fulfilling the goal of optimal land utilization, and for improving the security condition in the country communities. This paper gives some viewpoints on how to manage these idle lands： 1） make a clear judicial interpretation for ＂the idle lands＂; 2） optimize the legal system for the idle land; 3） establish relevant supporting policies to implement the law effectively; 4） strengthen the law enforcement for the reclamation and optimize the supervision system.
