摘要
管辖权、成本、效率等因素导致传统的法院不能适应电子商务B2C模式下消费纠纷的解决,网上消费者仲裁作为ODR的一种形式,正逐步替代法院成为主要的争议解决方式。在网络技术日新月异的背景下,应当采用与传统的商事仲裁不同的模式,建立政府支持和监督下的以市场自治为主体的网上消费者仲裁机制。
For reasons of jurisdiction, cost, efficiency and other problems related to traditional litigation, courts may not be a feasible forum for B2C consumer dispute. Online consumer arbitration, as a form of ODR, is becoming the primary way to solve B2C dispute. In the fast moving technical world of the Internet, contrast to traditional commercial arbitration, the paper concludes that under the support and intendance of guvemment, the self-regulating online consumer arbitration should be built.
