摘要
河南农民工张海超"开胸验肺"事件,暴露出农民工职业病防治问题严重,突出表现在农民工患病后维权困难,企业防治措施不到位,相关部门对农民工职业病问题重视不够等方面。这些问题的产生,主要是由于政府对企业监管不力、相关法律存在缺陷、管理体制不顺、基层职业病防治能力不强等原因。由于农民工已成为职业病危害的主体,应多管齐下,建立"以农民工为重点,政府主导,企业负责,全社会共同参与"的职业病防治体系。
The event that Zhang Haichao, a peasant from Henan Province, opened up his chest to prove he had occupational lung disease exposes the severe problems in the prevention and cure of oc- cupational disease of migrant workers, shows the difficulty of migrant workers in protecting their rights after getting diseases, the inappropriate measures of enterprises to prevent and cure diseases, and the less importance attached to the problem of migrant workers＇ occupational diseases by related depart- ments. These problems derive from weak supervision of government over enterprises, defects in related laws and management systems, and weak capability of disease prevention and cure at grass root level. Because migrant workers become the subjects of occupational diseases, it is necessary to establish oc- cupational disease prevention and cure system that ＂takes migrant workers as focus＂, and in which ＂government plays a leading role, enterprises take responsibility, and all the society participate＂.
