摘要
"小产权房"问题的实质是集体建设用地使用权流转能否合法化。现行法律规范存在矛盾,无法有效地对集体建设用地使用权的流转进行规制。所有权、用益物权的法理为集体建设用地使用权流转的合法化提供了理论支撑。《广东省集体建设用地使用权流转管理办法》是集体建设用地使用权流转立法探索的典型,本文在其基础上对集体建设用地使用权流转制度的完善提出建议。
The essence of the problem of Small Property Room is whether the transference of usufruct of collective construction land can be legalized. The existed legal norms are contradicted that they can't effectively regulate the transference of usufruct of collective construction land. The jurisprudence of ownership and usufructuary right supports the legalization of the transference of usufruct of collective construction land. The regulation in Guangdong is a representative of legislation in this area, on which to base the advices put forward in the article on the perfection of legal system of the transference of usufruct of collective construction land.
