摘要
英美法系和大陆法系是当今世界主要法系,其优秀的法律制度为我国法治建设提供了许多有益的借鉴,其中的律师制度拥有毋庸置疑的重要地位。本文从历史发展、类型职能、资格取得、权利义务四个方面,对英美法系和大陆法系的律师制度进行宏观的比较,在此基础上就其成功经验探讨了对我国律师制度改革的现实借鉴。
British-American law system and the Continent law system are two major legal systems in the world that offer valuable cxpericnce to Chinese legal construction. Lawyer system is an important part in legal system. The essay makes a comparison between two legal systems and points out the significance to the development of Chinese lawyer system from the following perspectives; history and development, modes and function, qualification and identification, rights and duties.
