摘要
运用专家访谈和逻辑分析等方法,从法理学角度阐释体操裁判自由裁量权的含义与特征;从规则的不完备性、规则确认的自由裁量和规则与事实对接等3方面分析体操裁判行使自由裁量权的存在依据;从证据确认、事实认定和规则适用3方面论述体操裁判评分自由裁量的程序,并运用上述原理分析近年来在世界体操大赛中有关裁判评分自由裁量权的个别案例。
The paper used the method of literature review, investigating experts, logical analysis, explained the meaning and characteristic of the judicial discretion on referee of gymnastics from the view of the Free Jurisdiction, introduced the different conjunction to the judicial discretion and the main reasons, and preliminarily explained the need of the judicial discretion based on the jurisprudence and economics perspective to the study. From three aspects the procedure of free jurisdiction was described, namely, evidence confirmation, facts determination and rules adoption. The selected cases from the FIG competition recently were analyzed, and the purpose is to make the analysis more general.
