摘要
没收财产刑执行难的问题在我国司法实践中普遍存在。目前没收财产刑判决执行率低,限制了其刑罚功能的充分发挥,也有损法院生效判决的严肃性和权威性。采取完善立法,构建财产刑执行强制机制,完善财产刑执行失误后的救济措施等方法,可以在一定程度上解决我国没收财产刑执行难的问题。
The difficulty of implementing property forfeiture law is widely seen in China＇ s judicial practice, thereby impairing the authority of criminal laws, limiting its penalty function into full play, undermining the predictive function of criminal laws and violating the principle of suiting punishment to crime. Using these methods, such as improving legislation, building the mechanism of property forfeiture, improving the measures after performing the property forfeiture for failures can solve the difficulty of implementing property forfeiture.
