摘要
从知识产权的经济实质是追求知识产权利益相关方的利益平衡出发,从经济与法律双重角度,讨论了数字图书馆建设中的知识产权保护与信息资源最优利用的矛盾及表现,指出数字图书馆建设中促进知识创新与信息资源最优利用的根本途径在于重建利益衡平机制,而其关键在于消除知识产权的过度排他性制度安排对数字图书馆发展的制约。
Staring from that the economic substance of intellectual property rights is to seek the interest balance of interested parties of intellectual property rights, and from the angles of economy and laws, this paper discusses the conflicts between intellectual property protection and optimized utilization of information resources in the construction of digital library and the representations of these conflicts, and points out that the fundamental way for promoting the knowledge innovation and optimal utilization of information resources is to rebuild the interest balance system, and the key is to eliminate the restriction of undue excessive institutional arrangement of intellectual property rights to the development of digital library.
