摘要
从航次租船的特点出发，论述了在船舶航次租船业务中，船长作为运输船舶的管理者，同时也是在航次租船合约下的直接履约者，其所处的法律地位．并提出了整个航次租船业务中，船长在履约中出现的若干问题，并加以探析、解决．
According to the characteristics of shop′s voyage charter,this paper describes the captain′s legal status as a manager of the vessel and as the first carrier of the ship′s voyage charter,and discusses the problems that the captain will meet and must consult the vessel sail and voyage charter.
