摘要
空间权是因土地立体化利用而产生的一种权利。我国对空间权法律制度的规范与保护经历了萌芽探索、学者争议到立法肯定的过程。《物权法》出台前,一些地区已通过各种形式探索,并对空间权有所规定;《物权法》制定时,学者又对空间权之立法体例形成了独立与非独立的两派意见;最终,《物权法》第136条以地上、地下建设用地使用权的法权形式肯定了空间权法律制度。《物权法》的规定比较简单,需要进一步对其进行深入理解,以形成完整的空间权制度内容。但现行法对空间权的规定还存在适用范围有限、不能应对解决所有空间利用的问题等不尽完善之处,因此,空间权法律制度尚有进一步充实和发展的空间,应通过拓展地役权制度、设立公共地役权制度、规范集体建设用地使用权、完善土地征收制度,补充挖掘这些土地制度中的空间内容,来进一步完善空间权法律制度。
The air space right is a new type land right for the three- dimensional use of the land. The regulation and protection for the air space right have gone through the course of exploring its infancy, the academic controversies and the legislation. Before the promulgation of Property Law, there were various forms of local exploration of air space right. When Property Law enacted, scholars divided into two groups of views which the legislation style of space right should be dependent or independent. Ultimately, the Article 136th of Property Law has established the space right by specifying the use - fight of underground and over- ground construction land. But the regulation is so simple that should be enriched a complete content of the space right system. However, current law provisions with the limited application scope can' t respond to all the conditions of space utilization. Therefore, there is a room for further enrichment and development for the space right system. We put forward some suggestions such as expanding the easement, setting up a public easement system, standardizing the collective construction land use rights, improving the land acquisition system.
