摘要
现代知识产权法在实践中带来了许多令人担忧的社会问题,从而引起了人们对这一新型法律制度的质疑。本文认为导致这种局面的根本原因是知识产权法价值的伦理迷失。因此,基于法价值范畴,重新审视知识产权法工具性价值和伦理性价值关系,检思知识产权法价值实然状态与应然主张的背离样态,探索知识产权法价值的伦理回归显得非常必要。法理念构建、法权利限制与法体系完善构成了知识产权法伦理价值回归的基本路径。
The practice of Law of Knowledge Property gives rise to many problematic social issues and questioning concerning this new legal system.This article believes that the basic reason for this situation lies in the ethical loss of the value in this law.Therefore,based on the value of the law,a re-examination of the relation between its instrumental value and ethical value,of the deviation of the real condition and the due proposition,and of the ethical return of its value becomes very important.The basic path for its return composes of the construction of its legal idea,the restriction of its right and the perfection of its system.
