摘要
新西兰医疗伤害无过失补偿制度是一项颇具特色的制度,对于及时、有效救济医疗伤害的当事人具有重要意义。该制度的运行主体是作为政府机构的新西兰意外事故补偿委员会(ACC),适用对象为国内外的所有新西兰公民、居民和临时来访者,给付内容包括服务和金钱。该制度的适用范围正日益扩大,程序较为简单,资金来源主要为政府拨款。本文对新西兰的医疗伤害无过失补偿制度的沿革与内容做一介绍,以期对完善我国的医疗伤害救济体系有所助益。
New Zealand＇s no-fault compensation system for medical injury is characteristic. It is of very important significance to relieve the victim of medical injury timely and effectively. The main role in the system is the accident compensation committee （ACC） of the government. The system is applicable to domestic and foreign New Zealander, dweller and temporary visitor. The system＇s presentation consists of service and money. The applying domain of the system is expanding and the applying procedure is simple. The money of the system mainly comes from the funds allocated by the government. In this paper we introduce the evolution and presentation of New Zealand＇s no-fault compensation system for medical injury so as to do help for no-fault compensation system for medical injury in China.
