摘要
"服务型政府"理论是在当前国家和社会转型及改革背景下对"行政法治"理论的进一步深化。在行政法领域,"服务型政府"理论必定对传统"高权"行政行为的变革产生重要影响。"行政法上金钱给付义务"的强制执行就是一个典型范例。在该强制行为中,程序正当、民主参与和公民便利的请求权等将是其改革方向。
＂Service-oriented government＂ is the development to the theory of ＂administration according to the law＂. It will have significant impacts on traditional administrative actions. The enforcement of the money paid on the administrative law will be a typical example. In the development process of ＂enforcement of the money paid on administrative law＂, due process, democratic participation and the right of claim are directions of reform.
