摘要
行政许可是政府管理社会政治、经济、文化等多方面事务的一种事前控制手段。要防止行政许可工作人员违法实施行政许可和滥用权力,保护公民、法人和其他经济组织的合法权益,必须加强对行政许可机关实施许可活动的监督、制约与救济。如何完善行政机关实施行政许可的监督与制约机制,为相对人提供有效的救济途径,是近年来学界重点关注的问题之一。本文对我国行政机关实施行政许可监督救济的现实意义、基本途径及存在的问题、完善措施等进行了阐述。
Administrative licensing is a social and political governance,economic,cuhural and other aspects of a transaction prior controls.To prevent the administrative licensing staff in the implementation of administrative licensing law and abuse of power,pro- tection of citizens,legal persons and other economic organizations of the legitimate rights and interests,we must strengthen the im- plememation of administrative licensing authorities licensing activities,monitoring,constraints and relief.How to improve the executive authorities to implement the administrative licensing mechanism for the supervision and restraint,in order to provide effective relief the relative way in recent years,scholars focus on one of the issues.This article on China＇s administrative organs to implement the administrative licensing oversees the relief and immediate significance and problems of the basic ways to improve the measures are described.
