摘要
随着国家惠农政策的实施以及土地价值的上升,土地权属的争议也开始大量涌现。在调研乡镇,按照纠纷主体划分,当前的土地纠纷主要包括三种基本类型:农户之间的土地争议、农户与村集体之间的土地争议以及村民小组与村集体之间的土地争议。在某种程度上,三种类型土地纠纷的实质是土地升值所导致的利益之争。因此,土地纠纷的化解既需要法律法规的进一步完善,更需要一种利益协调机制的建立。
Along with the benefits of agricultural policy implementation and the land appreciation, a lot of land ownership disputes emergent. According to the main body of the dispute, the current land disputes include three basic types： land disputes between farmers, land disputes between farmer and the village collective, land disputes.between villagergroup and the village collective., The essence of these three types of land disputes is the interests on the land appreciation to some extent. Therefore, we should improve the laws and regulations to resolve land disputes. At the same time , we should establish an interest coordination mechanism.
