摘要
规则是法治实现过程中最重要的因素之一。但长期以来我们对规则的重视程度不够。这是今天中国法治搞不好的最重要原因。人们对规则的态度在一定程度上决定着法治实现的程度。对规则的解释需要根据规则本身的特性来决定。对明确的法律规则只需认定,而不需要哲学意义上的解释。对法律规则的解释,应坚持文义解释优先原则,但文义解释优先绝不是死抠字眼,而是在权利义务、职权责任关系中释放法律规则的意义。
Legal rules are the important factors in the realization of rule of law. But they have been long neglected, which may be the reason why the construction of rule of law in China still falls behind, The extent of rule of law depends on the attitude to legal rules. The interpretation of legal rules relies on its own character. As to the clear legal rules, we do not need to interpret them. As to the interpretation of legal rules, we should follow the contextual meaning of rules first. However, context does not only mean the choices of words, but means to release the meanings of rules in the relationship between rights and obligation.
