摘要
正当法律程序是美国一项著名的法律制度,对世界各国的法治建设都有深刻影响。受制于对程序认识的若干偏差,人们对正当法律程序价值的认识总是带有片面性,缺乏对其真正价值的认识。程序有其自身的独立价值,正当法律程序也并非工具意义的程序。从宪政意义上讲,正当法律程序是美国法治大厦的支柱之一。
Due process of law is a well known legal system in U.S.,which has a profound influence on the rule of law around the world.Due to the limitation of the cognition of process,people always misunderstand due process of law and can not find its real value.Procedures have their own intrinsic value,and due process of law isn t only considered as instrumentalism.From constitutional sense,due process of law is one of the pillars of the building of laws in USA.
