摘要
罚金刑的适用对于惩治和预防各种贪利性犯罪有着独特的不可替代作用。然而,由于我国罚金制度本身存在的问题及法官适用罚金刑时的随意性,使得罚金刑在适用上存在诸多的问题。本文仅就罚金刑的适用范围、数额、罚幅;犯罪分子缴纳罚金的能力;对未成人适用罚金及适用罚金刑的监督等问题作一些探讨,以阐述作者的一些看法。
The use of fine punishment system has brought about some irreplaceable effect in punishment and prevention of criminal offenses. Meanwhile, the existing problems of fine punishment system itself and the fluidity of the judgers have also caused sever problems. In this paper the author mainly centralizes in the problems of the scope, amount and extant of fine punishment, the offenders＂ ability of turning in fine, the application of fine punishment to minors and the monitoring programs in the application of fine punishment system to give some ideas of his own.
