摘要
建立执行异议之诉是民事诉讼法修改的亮点之一,但仍存在立法缺陷。文章根据执行异议之诉当事人的规定及理论基础,提出了立法完善建议,以确保当事人的合法权益得以实现。
It is a light point to build up the objection to execution lawsuit.But the deficiency can be found.Based on the theory foundation and relative regulations,the article pointed out the suggestions to improve the law,and insured the legal rights can be realized.
