摘要
随着高校诉讼案的增加,高校的法律地位问题引起了学术界、司法界的广泛关注,形成了事业单位法人、公法人、公法人中的"特别法人"、法律法规授权组织、第三部门等不同观点。我国公立高等学校的法律地位具有三重身份,即事业单位法人、法律法规授权组织、行政相对人。高校招生权是法律法规授予高校的行政权力,在实施招生权的过程中高校与考生构成的是外部行政法律关系,当考生认为高校在实施招生权的过程中对其受教育权造成了侵害,适用于行政诉讼,可以寻求行政赔偿。
University lawsuit has increased in recent years, the legal status of institutions of higher learning forms public institution corporate, public corporate, ＂special corporate＂ of public corporate, organization empowered by law and regulations and third department. In fact, the legal status of Chinese public institutions of higher learning has a triple identity, namely： public institution corporate, organization empowered by law and regulations and administrative object. College entrance right is the executive powers of organization empowered by law and regulations, colleges and students constitute external administrative law relations in the implementation enrollment process of college, when the college students think their right to education is against, they apply to administrative proceedings and can find the executive compensation.
