摘要
法治不能没有标准,因此关于"法治原则"的探讨总是在法学理论中被不断提出。《商君书·定分》中的"孝公难题"包含了法治的"四项基本原则":法律传递的明知原则、法律遵守的用之原则、法律实施的如一原则和法律执行的无私原则。这四项法治原则贯通古今的普遍意蕴,设立了确定法治实现与否的衡量标准,也同时指出了法治进程的实践方向。
The Rule of Law can＇ t on standard, so it is always discussed in law theory. The Xiaogong Question from the Chapter Title Firing in the Book of Lord Shang have four basic principles of the Rule of Law, which are the transfer of law, the abidance of law, the implement of law and the performance of law. The four principles give the evaluations of the Rule of Law, and point out it＇ s practical directions.
